PODS Enterprises, LLC (“PODS”) may, from time to time, offer the opportunity to refer friends to use PODS ("PODS Referral Program"). We reserve the right to terminate the PODS Referral Program (“Program”) at any time for any reason without notice. Participation in the PODS Referral Program is at all times subject to your compliance with the PODS terms and conditions and the following terms herein.

PODS Referral Program Participation, Generally

To participate, you must follow the instructions to refer friends, family members or colleagues to the PODS Referral Program. Individuals who submit referrals are called "Referrers”. Individuals who are referred through the Program are called "Referred Customers”. Referrers and Referred Customers who are fully compliant with these terms of use will each earn the “Benefit” associated with the PODS Referral Program. By entering the Referral Program and providing PODS with an email address through the Referral Intake Form, the Referrer and Referred Customer are opting-in to receive commercial email marketing from PODS. 

Eligible Referrer

The PODS Referral Program is open to customers whose location of service is in the forty-eight (48) contiguous United States, Hawaii and the District of Columbia who are at least eighteen (18) years of age or older. Officers, directors, managers and employees of PODS Enterprises, LLC (the “Sponsor”) and each of their respective parent companies, subsidiaries, affiliates, and related companies, advertising and promotion agencies, consultants and agents, as well the immediate family (spouse, parents, siblings and children) and household members of each such person, any others engaged in the development, production, execution or distribution of the PODS Referral Program are not eligible to participate. The PODS Referral Program is subject to all federal, state, and local laws and regulations, is void outside the forty-eight (48) contiguous United States, Hawaii, the District of Columbia and where restricted or prohibited by law. By submitting a referral, Referrers and Referred Customers unconditionally accept and agree to comply with and abide by these Official Rules and the decisions of PODS, which shall be binding in all respects.

Submitting a Referral

To submit a referral, the Referrer must provide PODS with the first name, last name, and email address of the Referred Customer through the Referral Intake Form. The Referred Customer must complete an order with the same email address that was submitted by the Referrer in the Referral Intake Form. If the Referred Customer completes an order with a different email address than what they were referred with, the Referrer cannot be attributed to the Referred Customer and neither party can receive a Benefit.

Once an Eligible Referrer has provided PODS with the Referred Customer’s name and email address, the Referred Customer will receive an email notifying them that they have been referred to PODS. The Referred Customer must book a container and complete an Initial Delivery after they have been referred for the Referrer and the Referred Customer to receive the Benefit of the Program. 

You cannot refer yourself or anyone with the same origination or delivery address as you. You may not refer yourself or someone else with the same email address. You may not create multiple orders with PODS and refer yourself with a secondary email or participate in the PODS Referral Program using multiple or fake email addresses or identities. 

If a Referred Customer is referred to the PODS Referral Program by multiple Referrers, PODS will attribute the Referred Customer’s completed order to the Referrer who submitted the first referral. There can only be one (1) “Qualified Referral” and one (1) Benefit rewarded per Referred Customer.

Qualified Referrals

A Qualified Referral means that all the following conditions are met:

1. The Referred Customer booked a container with PODS and has completed an Initial Delivery. If the Referred Customer completes an Initial Delivery without being entered into the PODS Referral Program through the Referral Intake Form, the order associated with the Referred Customer will not count as a Qualified Referral, and neither party will earn a Benefit; 
2. The Referred Customer submits an order after they have been referred by an Eligible Referrer. If a customer is referred to PODS after they have ordered, they will not pass through the validation process and cannot be eligible for a Benefit;
3. The Referrer and Referred Customer’s location of service is in the forty-eight (48) contiguous United States, Hawaii, and the District of Columbia; 
4. The Referrer and Referred Customer are at least 18 years old; and
5. The Referred Customer has not already received a Benefit as a Referred Customer

Earning A PODS Referral Program Benefit

Eligible Referrers will receive one (1) Amazon.com Gift Card* valued at $50 for every Qualified Referral accepted. Eligible Referrers have no limit to how many people they can refer to PODS, however there is a maximum number of five (5) referrals they can be rewarded for. 

Referred Customers will receive one (1) Amazon.com Gift Card* valued at $50 once the initial referral becomes a Qualified Referral according to these terms. Referred Customers can only be rewarded once as a Referred Customer. If a Referred Customer becomes a Referrer, they will be subject to the terms of a Referrer as outlined herein. 

The Referred Customer must complete their Initial Delivery no later than one (1) year after their referral submission date to earn a Benefit for them and their Referrer. 

The Referred Customer’s order creation date must be after their referral submission date for the referral to be validated. If there is no new order created by the Referred Customer after they have been submitted into the Program by the Referrer, the order cannot be tracked and marked as delivered, preventing both parties from being rewarded for the referral.  

All referrals are subject to verification. PODS may delay issuing a Benefit for the purposes of investigation. PODS holds the right to refuse your reward if through the verification process it has been discovered that you have broken these terms. PODS may also refuse to verify and process any transaction PODS deems, in its sole discretion, to be fraudulent, suspicious, in violation of these terms of use, or believes will impose potential liability on PODS, its’ subsidiaries, affiliates or any of their respective officers, directors, employees, representatives or agents.

Once a referral has been verified and an Initial Delivery has been completed, an Amazon.com Gift Card valued at $50 will be sent within the first fourteen (14) business days of the Referred Customer’s completed Initial Delivery date. The Amazon.com Gift Cards will be sent to the email addresses provided to PODS by the Referrer through the Referral Intake Form. The Referred Customer must complete an order with the email address that was submitted with the referral to qualify both the Referrer and the Referred Customer for the Benefit. 

The emails submitted in the intake form are the only email addresses eligible to receive a benefit for a Qualified Referral. If the email containing the Amazon.com Gift Card bounces for any reason, it is not PODS liability, a new gift card will not be issued, nor will a new email address be accepted to disburse the Benefit.

Additional Terms, Conditions, Exclusions, and Restrictions

Only individuals may participate in the PODS Referral Program. Benefits accumulated under the PODS Referral Program are for individual use only and may not be transferred to any individual, group, company, or other entity. PODS is not responsible for any entry that is lost, late, misdirected or undeliverable, whether due to system errors, omissions, interruption, deletions, defects, delay in operations or transmissions, theft or destruction or failures, faulty transmissions or other telecommunications malfunctions, entries not received resulting from any hardware or software failures of any kind, lost or unavailable network connections, failed, incomplete or garbled computer or telephone transmissions, typographical or system errors and failures, faulty transmissions, technical malfunctions, or otherwise. Officers, directors, managers and employees of PODS Enterprises, LLC (the “Sponsor”) and each of their respective parent companies, subsidiaries, affiliates, and related companies, advertising and promotion agencies, consultants and agents, as well the immediate family (spouse, parents, siblings and children) and household members of each such person, any others engaged in the development, production, execution or distribution of the PODS Referral Program are not eligible to participate. Any Amazon.com Gift Cards you have earned, as well as your participation in the PODS Referral Program, are personal to you and may not be sold, transferred, or assigned to, or shared with, family, friends, or others. We reserve the right (in our sole discretion) to deduct Amazon.com Gift Cards that were issued in error or that were not earned legitimately. Partial redemption of Benefit is not allowed. Amazon.com Gift Cards may not be reused. Participation in the PODS Referral Program and the receipt of or redemption of an Amazon.com Gift Card may result in tax liability to you. Any tax, liability, or expense arising from participation in the PODS Referral Program, and accumulation or redemption of Amazon.com Gift Cards by you is your sole responsibility. We reserve the right to modify, limit, terminate, discontinue, or cancel the PODS Referral Program, its benefits, and these terms at any time in our sole discretion and without notice to you. You agree PODS will not have any liability for any modification or termination of the PODS Referral Program, even if any modification or termination affects your ability to use any Amazon.com Gift Cards already accumulated. We are not responsible for Amazon.com Gift Cards lost through your own negligence, or due to fraudulent or unauthorized use of your account. You agree not to engage in fraud or abuse in the accumulation of Amazon.com Gift Cards provided to you. Any fraud or abuse relating to your accumulation of Amazon.com Gift Cards or submission of Referred Customers may result in the annulment of all Amazon.com Gift Cards earned under the PODS Referral Program. We reserve the right to monitor all PODS Referral Program account activity and terminate your participation in the PODS Referral Program if PODS believes (in its sole discretion) that you have violated these Terms of Use, or the pods.com Terms of Use (including the Amazon.com Gift Card Terms of Use) or any other terms applicable to the PODS Referral Program. PODS will have the final decision in any disputes over Qualified Referrals, or your participation in the PODS Referral Program.
